TERMS AND CONDITIONS OF USE AGREEMENT

KU and Participant shall be hereinafter collectively referred to as “Parties”, and individually as a “Party”. 
SUBJECT MATTER OF THE AGREEMENT
ARTICLE 2.
Herein this “Terms and Conditions of Use Agreement” (hereinafter referred to as “Agreement”) the context of the “Synapsist’19 Summer School” (hereinafter referred to as “Program”) via the medicine.ku.edu.tr (hereinafter referred to as “Web Site”) between KU and Participant, the web site registration and fee payment transactions regarding the implementation of the parties rights and obligations are regulated by Law No 6502 and in accordance with relevant regulations.  
SPECIAL PROVISIONS 
ARTICLE 3.
3.1. Essential Feature of the Service Agreement
Within the scope of this Agreement, the details of the service which is provided by KU and European Medical Students’ Association (EMSA KU) which is a KU club the schedule are, 18-25th August 2019.
3.2. The Contract Program’s Scope and Fee 
3.2.1. Within the scope of this Agreement, the content of the Program that Participant will attend;

•	An academic program composed that the lessons related to the Reproductive Health and Fertility, Lectures, Panels, Workshops
•	Optionally accommodation in Koç Üniversitesi Rumeli Feneri Campus four people dorm room and social activity,
3.2.2. The Contract Program’s Fee and Payment
Within the scope of this Agreement, the fee of the Program is as follows included all taxes.
Payments will made via the online system.
180 €	Total Fee


3.3. Participant’s Right of Withdrawal and Use of Right of Withdrawal
3.3.1. Right of Withdrawal
Participant has the right of withdrawal from the Agreement within 14 (fourteen) days without declaring any reasons or paying any penalty. Participant’s right of withdrawal period commences on the since the Agreement is about performing a service.
The Agreement will be established as the Participant makes the payment via the Web Site clicking the “…” button and complete the registry by filling the form which contains the payment link. Participant’s right of withdrawal period will start at the payment date.
3.3.2. The Exercise of Right of Withdrawal 
Participant may claim the right of withdrawal to KU in writing within 14 (fourteen) days. The notification of right of withdrawal would be send by Participant to the full address which stated at Article 1 or electronic mail address which stated at Article 4.1. in due of time.
KU is obliged to return all payments, which are collected from Participant within fourteen days from the date of notification of notice of withdrawal. Reimbursement will be made according to payment method used by Participant, without charging any expenses or liabilities to Participant, will be carried at once. KU cannot be held responsible for commissions and -regardless of the name- any other deductions implemented by the Participant’s bank. 
Participant is not entitled to use the right of withdrawal, after the fourteen day of right of withdrawal period. Thereto, if Participant attends the Program before the right of withdrawal period run out, Participant did not entitled to use the right of withdrawal. 
GENERAL PROVISION
ARTICLE 4.
4.1. Participant could contact with KU through the +905336933773 telephone number and emsa@ku.edu.tr electronic mail address. 
FORCE MAJEURE
ARTICLE 5. 
The cases that happen without the control of the Parties such as natural disasters, wars, mobilization, fire, health status changes, strikes and lockouts and the government or legal decisions that stop the working conditions of both or one of the parties partially or completely, temporarily or permanently shall be considered as Force Majeure to the extent that they affect the execution of the provisions of the Contract hereby. 
In the event that Force Majeure lasts longer than two (2) months, the Parties shall be entitled to terminate the Contract by written notification. 
CONFIDENTIALITY
ARTICLE 6.
KU will not share Participant’s any personal information with third parties without written permission. Correspondingly, Participant will not share the agreement proposal proposed by KU to her/him with third parties.
STORAGE OF AGREEMENT AND ACCESS
ARTICLE 7. 
Agreement shall be kept for 3 (three) years by KU. Upon the Participant’s request, text of the agreement will be sent to address referred at article no. 1 above. 
SIGNATURE
ARTICLE 8.
This Agreement consists of 8 (eight) main articles and 3 (three) pages and will come into force when the payment link is transmitted to Participant by KU, after application and then approval of Participant via the web site.

KOÇ ÜNİVERSİTESİ TARAFINDAN YÜRÜTÜLEN HİZMETLERE İLİŞKİN ÖDEME FAALİYETLERİ KAPSAMINDA KİŞİSEL VERİLERİN İŞLENMESİNE İLİŞKİN AYDINLATMA METNİ

a)	Veri Sorumlusu ve Temsilcisi
6698 sayılı Kişisel Verilerin Korunması Kanunu (“6698 sayılı Kanun”) uyarınca, kişisel verileriniz; veri sorumlusu olarak Koç Üniversitesi (“Kurum” veya “Üniversite”) tarafından aşağıda açıklanan kapsamda işlenebilecektir. 

b)	Kişisel Verilerin Hangi Amaçla İşleneceği
Toplanan kişisel verileriniz, Üniversitemiz kurumları tarafından yürütülen faaliyetler ve sunulan hizmetlere ilişkin ödemelerin alınması; hukuki yükümlülüklerimiz kapsamında yaptığınız ödemelere ilişkin faturalandırma süreçlerinin yürütülmesi gibi amaçlarla ve 6698 sayılı Kanun’un 5. ve 6. maddelerinde belirtilen kişisel veri işleme şartları dahilinde işlenecektir.    

Kişisel verilerinizin Kurumumuz tarafından işlenme amaçları konusunda detaylı bilgilere; www.ku.edu.tr  yer alan Koç Üniversitesi Kişisel Verilerin Korunması ve İşlenmesi Politikası’ndan ulaşabilirsiniz.  

c)	İşlenen Kişisel Verilerin Kimlere ve Hangi Amaçla Aktarılabileceği
Toplanan kişisel verileriniz, işbu aydınlatma metninin (b) maddesinde belirtilen amaçlar ile www.ku.edu.tr adresinde yer alan Koç Üniversitesi Kişisel Verilerin Korunması ve İşlenmesi Politikası’nda belirtilen amaçlarla sınırlı olarak ve 6698 sayılı Kanun’un 8. ve 9. maddelerinde belirtilen kişisel veri işleme şartları çerçevesinde Koç Holding ve Koç Topluluğu Şirket ve Kuruluşlarına, Mezunlar Derneği’ne, iş ortaklarımıza, hissedarlarımıza, iştiraklerimize, kanunen yetkili kamu kurumları ve özel kişilere aktarılabilecektir.

ç)    Kişisel Veri Toplamanın Yöntemi ve Hukuki Sebebi
Kişisel verileriniz Üniversitemiz tarafından yukarıda (b) ve (c) maddelerinde belirtilen hukuki sebeplerle, Üniversite ile gerçekleştirdiğiniz iletişim faaliyetleri kapsamında doldurduğunuz elektronik (online) tahsilat platformu aracılığıyla elektronik ortamda toplanmaktadır.     

 
d)	Kişisel Veri Sahibinin 6698 sayılı Kanun’un 11. Maddesinde Sayılan Hakları
Kişisel veri sahipleri olarak, haklarınıza ilişkin taleplerinizi [www.ku.edu.tr] yer alan Koç Üniversitesi Kişisel Verilerin Korunması ve İşlenmesi Politikası’nda düzenlenen yöntemlerle Üniversitemize iletmeniz durumunda Üniversitemiz talebin niteliğine göre talebi en kısa sürede ve en geç otuz gün içinde ücretsiz olarak sonuçlandıracaktır. Ancak, işlemin ayrıca bir maliyeti gerektirmesi hâlinde, Üniversitemiz tarafından Kişisel Verileri Koruma Kurulunca belirlenen tarifedeki ücret alınacaktır. Bu kapsamda kişisel veri sahipleri;   
•	Kişisel veri işlenip işlenmediğini öğrenme,
•	Kişisel verileri işlenmişse buna ilişkin bilgi talep etme,
•	Kişisel verilerin işlenme amacını ve bunların amacına uygun kullanılıp kullanılmadığını öğrenme,
•	Yurt içinde veya yurt dışında kişisel verilerin aktarıldığı üçüncü kişileri bilme,
•	Kişisel verilerin eksik veya yanlış işlenmiş olması hâlinde bunların düzeltilmesini isteme ve bu kapsamda yapılan işlemin kişisel verilerin aktarıldığı üçüncü kişilere bildirilmesini isteme,
•	6698 sayılı Kanun ve ilgili diğer kanun hükümlerine uygun olarak işlenmiş olmasına rağmen, işlenmesini gerektiren sebeplerin ortadan kalkması hâlinde kişisel verilerin silinmesini veya yok edilmesini isteme ve bu kapsamda yapılan işlemin kişisel verilerin aktarıldığı üçüncü kişilere bildirilmesini isteme, 
•	İşlenen verilerin münhasıran otomatik sistemler vasıtasıyla analiz edilmesi suretiyle kişinin kendisi aleyhine bir sonucun ortaya çıkmasına itiraz etme,
•	Kişisel verilerin kanuna aykırı olarak işlenmesi sebebiyle zarara uğraması hâlinde zararın giderilmesini talep etme haklarına sahiptir.
