KU and Participant shall be hereinafter collectively referred to as “Parties”, and individually as a “Party”.
SUBJECT MATTER OF TOU
ARTICLE 2.
Herein this “Terms of Use” (hereinafter referred to as “TOU”) defines the context of the “ORPHEUS 2022” (hereinafter referred to as “Program”) via the orpheus.ku.edu.tr (hereinafter referred to as “Web Site”) between KU and Participant, the Web Site registration and fee payment transactions regarding the implementation of the Parties’ rights and obligations are regulated by Law No 6502 and in accordance with relevant regulations and the provisions of this TOU.
SPECIAL PROVISIONS
ARTICLE 3.
3.1. Essential Feature of TOU
Participants will be able to register to “ORPHEUS 2022” and to pay their registration fees through the Web Site.
3.2. The Program’s Scope and Fees
3.2.1. Scope of the Program is generally as follows:
 It is most likely the largest platform in the field of health sciences across Europe, aiming to preserve the doctoral degree as a research degree and strengthen career opportunities for doctoral graduates. This annual meeting is the most attended meeting in this field.

3.2.2. The Contract Program’s Fee and Payment
Within the scope of this TOU, the registration fees for the Program, inclusive of taxes, are as follows:

3.3. Participant’s Right of Withdrawal and Use of Right of Withdrawal
3.3.1. Right of Withdrawal
The Agreement will be deemed concluded upon which the Participant makes the relevant registration fee payment via the Web Site and complete the registry by filling the form which contains the payment link. Participant has the right to withdraw from this TOU within 14 (fourteen) days following the payment date without declaring any reasons or paying any penalty.
3.3.2. The Exercise of Right of Withdrawal
Participant may claim the right of withdrawal to KU in writing within 14 (fourteen) days. The notification of right of withdrawal would be send by Participant to the full address which stated at Article 1 or electronic mail address which stated at Article 4.1. in due of time. KU is obliged to return all payments, which are collected from Participant within fourteen days from the date of notification of notice of withdrawal. Reimbursement will be made according to payment method used by Participant, without charging any expenses or liabilities to Participant, will be carried at once. KU cannot be held responsible for commissions and -regardless of the name- any other deductions implemented by the Participant’s bank or third party service providers.
3.4. KU’s Right to Modify the Program
KU has the right to modify the content of the Program or to postpone or to cancel the Program. Content change in the Program or postponement of the Program shall not grant any withdrawal right for the Participant. That said, in case of cancellation, KU shall repay the registration fee, without the obligation to pay any penalty or indemnification, in accordance with the procedure set forth in Article 3.3.2 of this TOU upon written request of the Participant.

ARTICLE 4.

FORCE MAJEURE
ARTICLE 5.
The cases that happen without the control of the Parties such as natural disasters, wars, mobilization, fire, health status changes, strikes and lockouts and the government or legal decisions that stop the working conditions of both or one of the parties partially or completely, temporarily or permanently shall be considered as Force Majeure to the extent that they affect the execution of the provisions of the Contract hereby.
In the event that Force Majeure lasts longer than two (2) months, the Parties shall be entitled to terminate the Contract by written notification.
CONFIDENTIALITY
ARTICLE 6.
KU will not share Participant’s any personal information with third parties without written permission. Correspondingly, Participant will not share the agreement proposal proposed by KU to her/him with third parties.
STORAGE OF AGREEMENT AND ACCESS
ARTICLE 7.
TOU shall be kept for 3 (three) years by KU. Upon the Participant’s request, text of the TOU will be sent to address referred at article no. 1 above.
SIGNATURE
ARTICLE 8.
This TOU consists of 8 (eight) main articles and 3 (three) pages and will come into force when the payment link is transmitted to Participant by KU, after application and then approval of Participant via the web site.

3. Essential Feature and Scope of the Program
The details of the services to be given by Koç Üniversitesi İktisadi İşletmesi (“KU”) are as follows:
The service shall be given to the Participant by KU, between the dates of 12 May 2022-14 May 2022 via the orpheus.ku.edu.tr.

5. Additional Cost to Consumers
None.
6. Information on Execution/Undertakings and Solution Procedure of Complaints.
KU is obliged to execute the services on the Program according to the Agreement. The Participant can send all his/her proposals or complaints to KU’s telephone number or e-mail address as stated in the Article 2. KU aims to investigate and solve all kind of complaints and proposals sent by the Participant, under the legal framework. All kind of lawful rights of the Parties shall be reserved.
7. Right of Withdrawal
The Agreement will be deemed concluded upon which the Participant makes the relevant registration fee payment via the Web Site and complete the registry by filling the form which contains the payment link. Participant has the right to withdraw from the Program within 14 (fourteen) days following the payment date without declaring any reasons or paying any penalty.
Participant may claim the right of withdrawal to KU in writing within 14 (fourteen) days. The notification of right of withdrawal would be send by Participant to the full address which stated at Article 2 or electronic mail address which stated at Article 8 in due of time. 9. The Conditions Where the Right of Withdrawal Cannot be Executed
The Participant cannot use the right of withdrawal, after the fourteenth day of right of withdrawal period.
After the Program has started, the Participant will not request any refund if they cancel their participation in the program for any reason other than force majeure or will not request any refund in case of early departure from the program.
In addition, if the Participant participated in the program before the right of withdrawal period expires, the Participant will not be able to exercise the right of withdrawal.
KU has the right to modify the content of the Program or to postpone or to cancel the Program. Content change in the Program or postponement of the Program shall not grant any withdrawal right for the Participant. That said, in case of cancellation, KU shall repay the registration fee, without the obligation to pay any penalty or indemnification, in accordance with the procedure set forth in Article 7 and upon written request of the Participant.

11. The Participant can apply to the Consumer Court or the Consumer Arbitration Committee for any dispute.

PRIVACY NOTICE
Koc University (“University”) occasionally stores and lawfully processes your data considered as “personal data” within the scope of the Law on Protection of Personal Data No: 6698 (the “LPPD”) within the scope of registration procedure for ORHPEUS congress. In this manner, we would like to inform you, in accordance with the LPPD and relevant regulations, regarding how and for which purposes personal data is processed by our University bearing the title “data controller” in accordance with the LPPD, and the technical and administrative measures taken in order to protect your personal data.
1. Principles Relating to Processing of Personal Data
Personal data is processed in the light of the principles below:
a) Lawfulness, fairness and transparency.
b) Accuracy and where necessary, keeping up to date.
c) Processing for specified, explicit and legitimate purposes.
d) Adequacy, relevancy and limitation to what is necessary in relation to the purposes for which they are processed.
e) Storing only as long provisioned by relevant regulations or necessary for the purposes for which they are processed.
2. Obligation to inform
Article 10 of the LPPD imposes an obligation on the data controllers to inform those whose personal data are processed whilst obtaining their consent in this regard and requires the data subjects to be informed. University, bearing the title ‘data controller’ in accordance with the relevant provision must inform the data subjects regarding:
a) the identity of the data controller,
b) the purposes for which the personal data are processed,
c) to whom and for what purposes the processed personal data may be transferred,
d) the methods and the legal grounds for the collection of personal data,
e) the rights which the data subject may exercise against the data controller in accordance with Article 11 of the LPPD.
As University, we are informing all our personnel regarding the processing and protection of personal data in accordance with Article 10 of the LPPD with this Privacy Notice.
3. Data Controller
Article 3/1(ı) of the LPPD defines data controller as “Real or legal persons who determine the purposes and means of processing personal data, who are responsible for the establishment and management of the data registry system” and within this framework, University bears the title of data controller.
4. What Personal Data Can Be Processed?
Your personal data collected via this platform varies according to purposes mentioned below. Your personal data collected can be listed as follows:
 Identity Information (name, surname)
 Communication Information (phone number, e-mail address)
 Information on Profession (The organization/company/university where the data subject works, profession of data subject)
 Financial Information (IBAN number)

5. Processing of Personal Data and its Purposes
At University, your personal data is only processed in the presence of your explicit consent or the presence of conditions of lawfulness for processing stated under LPPD.
In accordance with the principles under LPPD; your personal data is processed;
(i) To communicate with the speaker and/or participants before or after the congress,
(ii) To carry out the operations regarding the registration for congress,
(iii) To comply with the relevant regulatory, legal, inspection and compliance obligations.
6. To Whom and For What Purposes the Personal Data may be Transferred
Your personal data processed by the University in accordance with the LPPD principles and provisions; may only be transferred for the above-mentioned purposes and along with the necessary confidentiality agreements to legally authorized public institutions, within the scope of the conditions and purposes regarding the processing of personal data stipulated in Articles 8 and 9 of the LPPD.
As per Article 8 of the LPPD, the personal data may be transferred based on the express consent of the data subject or another condition stipulated in the above article with the heading ‘Processing of Personal Data and its Purposes’ in the absence of express consent.
7. Methods and Legal Grounds for the Collection of Personal Data
Your personal data, as mentioned above, are collected and processed within the scope of registration procedure for ORHPEUS congress. Your personal data may be processed and transferred for the purposes described in this Privacy Notice, primarily to fulfill our University’s obligations correctly and in full arising from legislation and agreements and to fulfill the conditions for the processing of personal data as defined in Articles 5 and 6 of the LPPD.
8. Rights of the Data Subject
Article 11 of the LPPD issues some rights for each real person whose personal data is processed and requires the data controllers to inform the data subjects on such rights under the obligation of inform. These rights are comprised of;
 the right to obtain from the controller confirmation as to whether or not personal data concerning him or her are being processed, and, where that is the case, access to the personal data and the following information; the purposes of the processing and whether the personal data is used in line with such purposes, the recipients to whom the personal data have been or will be disclosed both domestically and in abroad,
 the right to request from the controller rectification of personal data if the personal data have been processed in an incomplete and wrong manner,
 the right to request the deletion or destruction of personal data if the grounds permitting the processing of personal data do no longer exist within the scope of Article 7 of the LPPD,
 the right to request the notification of the third parties whom the personal data are transferred to regarding the rectification if the personal data have been processed in an incomplete or wrong manner or the deletion or destruction of personal data in accordance with Article 7 of the LPPD,
 the right to object to any adverse result that occurs exclusively from analyzing the processed personal data via automatic systems and right to claim compensation if any damage is incurred due to unlawful processing of personal data.
9. How Do We Protect?
The protection of your personal data collected and processed by University is provided through preventing unauthorized persons to access the data and by taking all necessary technical and administrative measures in order to make sure our personnel do not suffer from any violation, by ensuring the use of softwares by our University in

our operations are up to standards, by taking due care in choosing the third parties which we work with, by training our employees in this regard and by ensuring the compliance with the data protection policy within the University.
10. Application and Right to Obtain Information
In case you wish to exercise one of the rights explained above granted under Article 11 of the LPPD, you may apply to our University. This application should be made in writing or through other methods determined by the Personal Data Protection Board.

As a participant, in the event that I have attended online or physically, I accept my personal data composed of photographs, voice, and/or video records, to be processed and to be shared on the social media platforms belonging to the University.
